The Sikkim Democratic Front (SDF) has taken a firm stance against the recent issuance of Bind Down notices under Section 107, read with Section 111 of the Criminal Procedure Code (Cr.PC) 1973. The party deems these actions as a selective and vindictive approach by the concerned Magistrate against its members.
Traditionally, Bind Down notices are issued by executive magistrates as a standard procedure before elections to maintain peace in the area. These notices typically target habitual criminal offenders or individuals prone to inciting breaches of peace. However, the recent notices issued against members and senior leaders of the SDF Party deviate from this established practice and contradict the principles laid down under the Cr.P.C.
It is alarming to note that these notices have been served to individuals within our party who have no prior criminal record. Mere registration of a First Information Report (FIR) does not equate to being a convict or possessing a bad character. The issuance of these notices constitutes a violation of the Fundamental Rights guaranteed under Part III of the Constitution.
